Information on activity of the Representative of Oliy Majlis (Parliament) of the Republic of Uzbekistan on Human Rights in 2003
Activity of the Representative of Oliy Majlis on Human Rights (Ombudsman) in 2003 was carried out in conditions of reforming of legal base of a legislative branch of authority, perfection of the national legislation, the further development of democratic institutes, involving of public sector and mass media on principles of social partnership to the process of construction of a civil society, a deepening of cooperation of the Republic of Uzbekistan with foreign countries and the international organizations.

Parliamentary Ombudsman took part in preparation of bills "On Regulation of Senate of Oliy Majlis of the Republic of Uzbekistan", "On Regulation of the Legislative chamber of Oliy Majlis of the Republic of Uzbekistan", "On the use and protection of emblems of the Red Crescent and the Red Cross", "On bankruptcy", "On private enterprise", "On bank secret", "On currency regulation", "On the electronic digital signature", "On electronic commerce", "On electronic document circulation", and also, about modification and additions to the Law "On the Constitutional court of the Republic of Uzbekistan" and the Criminal - Executive code of the Republic of Uzbekistan.

Taking into consideration the necessity to bail the observance of electoral rights of citizens, the drafts of the laws "On modification and additions to the Law of the Republic of Uzbekistan", "On elections in regional, regional and city councils of People's Deputies", "On elections of the chairman citizens' assembly and his advisers" had been studied thoroughly and offers on them were passed to corresponding committees of the Parliament.

With a view of development of the offers directed on perfection of the legislation, the Representative of Oliy Majlis on Human Rights carries out monitoring of the current situation to bail the rights and freedom of citizens. In 2003 the monitoring on observance of the Law of the Republic of Uzbekistan "On the protection of citizens' health" regarding securing the rights of patients was carried out in Samarkand, Fergana, Andijan and Namangan regions. The purpose of monitoring is to reveal the reasons and the conditions generating infringements of the rights of citizens on qualified health services, informing of the population and medical workers about the rights of patients, studying of practice of the observance of the Law in activity of the state bodies and bodies of system of the public health services.

Results of monitoring, and also sociological interrogation of medical workers, patients and the population of researched regions have designated a number of the reasons constraining effective realization of the basic directions of the Concept to reform the public health services, which concern the absence of forecasting of needs for various categories of the medical staff; insufficient social security of medical workers; low material base of the Treatment-and-Prophylactic establishments; insufficiency in medical supplies, consumption materials and the diagnostic equipment; the weak control over the performance of the obligations in Treatment-and-Prophylactic establishments concerning granting the coordinated volumes of free medical services; imperfection of forms and methods of educational work in system of public health services; low knowledge and legal literacy of physicians and the population; absence of institutes of extrajudicial protection of the rights of patients and medical workers.

In 2003 the Representative of Oliy Majlis of the Republic of Uzbekistan on Human Rights) has received 5807 references from the citizens; to 1345 of them were given oral explanations and consultations. 1390 references over infringements of the rights and freedom of citizens were taken under control, where 320 of them were resolved positively, the others are being reviewed; the citizens own investigation were carried out for 70 references.

1210 references were received from the international organizations and foreign citizens about questions of securing the human rights in the Republic of Uzbekistan, and also 18 references about the affairs of foreign citizens.

The Representative of Oliy Majlis on Human Rights and his regional representatives carried out more than 80 meetings on places including the places of imprisonment, the supervision were arranged over a course of litigations for 40 criminal and civil cases.

The analysis of complaints from the citizens shows the tendency of increasing of the number of references from Tashkent city, Tashkent, Samarkand, Kashkadarya, Fergana, Andijan, Djizak, Navoi regions and the Republic of Karakalpakstan concerning questions to bail the legality and the law, and order, health services of the population, maintenance of social protection, protection of the labour rights.

Studying of references on questions of infringement of the rights in sphere of justice shows, that the majority of them are connected to unfairly long disposal of legal proceeding, red tape, bias of investigatory and judicial workers, discrepancy of judgement or their default, wrongful methods of conducting consequences, infringements of the rights of fugitives.

In the field of the labour rights citizens express disagreements with axing, being transferred into other jobs by the management of the ventures and organizations where they carry out their activity, untimely receiving the wages, the born decisions and definitions of courts on protection of this category of the rights.

In the sphere of the social rights the majority of references are connected to realization of the right on reception of social payments, unemployment benefits, infringement of procedure of being retired on age, physical inabilities, infringement about calculation of the sum of pensions, and also, with questions of rendering of medical aid.

In four regions of the country regional representatives have been elected, orders of bodies of the government on places on their material and resource support are issued. Now, the complex of measures on realization of the given decisions is being carried out. The regional representatives of Ombudsman have considered more than 800 references which are classified on identical categories of the references which have were received by the Head Office.

The Representative of Oliy Majlis on Human Rights, employees of his device and members of public formations have continued the practice of meetings in person in the organizations and establishments, law enforcement bodies, etc. Also meetings are carried out with staff of the State Customs committee, the Ministry of Emergency Measures, the Central bank of the Republic of Uzbekistan, regional branches of the Women's Committee of Uzbekistan, with the youth in educational institutions and the specialized structures both in capital, and in other regions of the country. The meetings with representatives and students of the Academy of State and Public construction under the President of the Republic of Uzbekistan, and the Tashkent Islamic university are being arranged constantly.

"The round table" was dedicated to the problems of the former condemned people and bringing them back to the society and carried out with participation of the foreign experts together with Tashkent regional government, representatives of Konrad Adenauer Fund, law enforcement bodies and public organizations. During that meeting the experience of Germany (city council Leipzig) on social rehabilitation of the people who had been condemned was shown.

The representative and its regional representatives have participated in seminars and the conferences organized by the Constitutional court and the State Office of Public Prosecutor of the Republic of Uzbekistan, and also, in the trainings which have been arranged by the Central Administrative Board of Punishments of the Ministry of Internal Affairs together with the Bureau of Democratic Institutes and Human Rights, OSCE and the «The International prison reform» organization.

In last period the work directed on strengthening of the mutual cooperation from mass-media has been continued. All the means arranged by Ombudsman for the last period were visited and supported by the representatives of all kinds of mass media.

The information about the Representative of Oliy Majlis on Human Rights activities was operatively placed on the web.

Cooperation of the Representative of Oliy Majlis on Human Rights with foreign colleagues, the international organizations on Human Rights extends every year.

In accounting year the Representative of Oliy Majlis on Human Rights arranges 25 receptions of representatives of the foreign states and the international organizations: official delegations of the Diet of Poland, the Senate of France, the Ministries of Justice of Germany, the USA, the Ministries of Foreign Affairs of Switzerland, the European regional bureau of the WHO, Bureau of Democratic Institutes and Human Rights of OSCE, and also chairman of the Supreme court of Georgia, ambassadors of Poland, Slovakia, Sweden in Uzbekistan, the head of the Center of OSCE in Tashkent, representatives of UNO, embassies of Germany, Switzerland and Japan. Nowadays the business relations with Human Rights organizations of more than 40 countries of the world, including the countries of Europe, the CIS, America and Asia have been established.

Last year the development of cooperation with International and European institutes on Human Rights has proceeded. Joint activity of the Representative of Oliy Majlis on Human Rights with the specified institutes was carried out by means of information interchange, the materials, the corresponding literature, participations in election of directing bodies, and also, in the other means.

The offer on an establishment of the constant cooperation with Human Rights organizations of Spain, Slovakia, Azerbaijan and Latvia are being discussed and reached their climax.

Taking into consideration the great importance of informing of the international public and foreign colleagues about activities of the Representative of Oliy Majlis on Human Rights, various international Human Rights organizations, embassies of more than 50 states of the world have received the editions of parliamentary Ombudsman, including the Report for 2002 and the book "The monitoring of human rights".
